Millburn Gets Green Light in Hayskell Development Case

After an arbitrator's ruling in favor of the township, Mayor Sandra Haimoff said Millburn will file for damages against developer.

Millburn Mayor Sandra Haimoff had good news to report at Tuesday night's Township Council meeting, The Alternative Press reported: The municipality won a ruling in its favor in an arbitration in a legal matter involving a developer that was held up by a dispute with the town's insurer, the Municipal Excess Liability Joint Insurance Fund.

The arbitration was launched by the township in 2001 regarding a case brought by Haykell Development, but a snag occurred when the insurer's refused to indemnify Millburn, the article said. The mayor on Tuesday announced that arbitrators decided that the insurance fund had a legal obligation to defend the township against possible tort damages in the case.

Haimoff said that thanks to the decision, the town will move ahead and file for damages in the Haykell Development litigation.
