No ordinance is in place regulating the installation of cell towers and antennas in Millburn-Short Hills.
The Millburn Township Committee is examining if there should be a zoning ordinance covering the installation of cellular towers. Township Attorney Christopher Falcon spoke with the committee Tuesday night about drafting an ordinance. Right now the township does not have an ordinance governing cellular towers, which means those who want to install a tower or antenna need to apply for a variance with the Millburn Zoning Board of Adjustment. Falcon said Tuesday night there are a lot of technical aspects to writing an ordinance governing cell towers, which makes it difficult for him to do. T-Mobile officials have asked to postpone their application to install a cellular tower in Short Hills, and the Zoning Board of Adjustment will not hear the case Monday night. Eileen Davitt, board secretary and zoning officer, said T-Mobile officials have asked for a month because they do not have enough of the requested information prepared for Monday's hearing. The hearing will be continued until Dec. 20, but it won't be heard at that date, she said. On Dec. 20 the board will set the next hearing date for the application, which is likely to be in January. A T-Mobile consultant testified before the Zoning Board of Adjustment Monday night, showing a map with the gap centered over a portion of Hartshorn Drive in Short Hills. The area, which was white on the map, is surrounded by green and yellow splotches, which are considered reliable coverage areas. The Zoning Board of Adjustment will be considering another cellular antenna in Short Hills this fall. Metro PCS has proposed placing eight antennas on the roof of the Hilton Short Hills, according to an application filed at Town Hall. The antennas will not be part of a tower like the one proposed by T-Mobile in Short Hills. Instead they will be flush mounted against the side of one corner of the building. Metro PCS is seeking a use variance from Zoning Board of Adjustment because the township's zoning ordinance does not allow for cellular antennas or towers. T-Mobile has proposed to construct a 140-foot cellular tower behind the Short Hills Terrace apartments at 806 Morris Turnpike. The proposed tower would be about 80 feet from the property line, adjacent to the train tracks. It also would be about 80 feet from the apartment building, which is tucked back from the road.
