Update: Zoning Board Denies Chai Center Variances

Rabbi and board plan to weigh their options and figure out what to do next.

After two years of hearings and almost 5½ hours of public input Monday night, the Zoning Board of Adjustment denied the variances sought by the Chai Center, which would have allowed a 16,350-square-foot synagogue in Short Hills.  Rabbi Mendel Bogomilsky said he and his attorneys would review their options, which range from looking for another lot to appealing the decision and continue fighting for the space they have now. “If this case goes to the Supreme Court, and it might, and it takes 10 years, the town won’t interfere with what we do now because they signed an agreement not to,” he said. “I don’t know what we’ll do, we’re keeping our options open, but we will continue operating as we are now.” That means, they will continue to hold …

Zoning Board Postpones Stop & Shop Hearing

Next meeting will be in January, after zoning board hires engineers to review testimony.

Concerned residents packed the house at the Zoning Adjustment Board meeting on Monday night, interested to see what might happen with the proposed Stop & Shop site in the old Saks building on Millburn Avenue. What they got was another date to come back to hear testimony from engineers, traffic engineers and planners about the effect that a 69,000 square foot grocery store would have on Short Hills, specifically Millburn Avenue. The issue was carried until Jan. 23, 2012, and board members told the public that there are other cases on the agenda so they should not bother getting to the meeting before 8 p.m. Although Stop & Shop had an engineer ready to testify, the issue was carried over to January because the zoning board wanted to hire an …

Zoning Meeting with Chai Center Postponed

Chai Center leaders needed more time, will present revised plan on May 2.

At the request of Chai Center leaders, The Millburn Zoning Board of Adjustment has postponed until May 2 a meeting to review the center’s revised plans for the proposed 16,350-square-foot building. According to Zoning Officer Eileen Davitt, the Chai Center was to bring revised plans to the board on Monday but those plans are not ready yet. So instead, they will discuss them at the next scheduled meeting. The controversial plans for the building -- proposed for 1.8 acres of residential property at Old Short Hills Road and Jefferson Avenue -- include a 144-seat synagogue, a library, a social room and multipurpose room. Summit Medical Group Still Intends to Build New Facility

The company withdrew its application in September, but there is no timeline for when it will resubmit.

Even though there isn't a timeline on when Summit Medical Group plans to resubmit an application for a new facility in Short Hills, the company plans to do so. The Berkeley Heights-based company is looking to develop the corner of Chatham and Woodland roads with a new facility. SMG has existing offices on Woodland Road. In September, though, the company withdrew its application with the zoning board of adjustment after one hearing at which neighbors raised concerns with the application. But the company does intend to come back with a new application that addresses the residents' concerns, according to Karen Graham, Summit Medical Group chief of operations. If the proposed Chai Center needs extra parking, the plans are to use Millburn Middle School down the street, but opponents have concerns. The center's traffic expert testified for a third time before the Zoning Board of Adjustment Monday night in the ongoing hearing for the proposal to construct a new synagogue at the corner of Old Short Hills Road and Jefferson Avenue. The next hearing is scheduled on Dec. 20 at 7 p.m. in Town Hall. Short Hills Cell Tower Hearing Postponed

T-Mobile officials have asked to postpone their application to install a cellular tower in Short Hills, and the Zoning Board of Adjustment will not hear the case Monday night. Eileen Davitt, board secretary and zoning officer, said T-Mobile officials have asked for a month because they do not have enough of the requested information prepared for Monday's hearing. The hearing will be continued until Dec. 20, but it won't be heard at that date, she said. On Dec. 20 the board will set the next hearing date for the application, which is likely to be in January. T-Mobile officials hope installing a cell tower near Morris Turnpike in Short Hills will fill a gap in its coverage. A T-Mobile consultant testified before the Zoning Board of Adjustment Monday night, showing a map with the gap centered over a portion of Hartshorn Drive in Short Hills. The area, which was white on the map, is surrounded by green and yellow splotches, which are considered reliable coverage areas. By installing the proposed cell tower, the area would have a more reliable coverage area, which was represented by a green and yellow spot on the map. It plans to submit a new plan to construct medical offices on Chatham Road in Short Hills.

Summit Medical Group has withdrawn its application to construct a medical office building in Short Hills, but it plans to submit a new plan. Zoning Board of Adjustment Chairman Joseph Steinberg announced the intention to withdraw the application during Monday's meeting. Summit Medical Group already had one hearing on its application and was scheduled to have a second on Oct. 4. There was opposition at the first hearing in August. The original proposal for the corner of Chatham Road and Woodland Road required seven variances, including parking, floor area ratio, height, setbacks, parking and slope disturbance. Cellular Antennas Proposed for Hilton

The eight antennas would be on the roof of the Short Hills hotel.

The Zoning Board of Adjustment will be considering another cellular antenna in Short Hills this fall. Metro PCS has proposed placing eight antennas on the roof of the Hilton Short Hills, according to an application filed at Town Hall. The antennas will not be part of a tower like the one proposed by T-Mobile in Short Hills. Instead they will be flush mounted against the side of one corner of the building. Metro PCS is seeking a use variance from Zoning Board of Adjustment because the township's zoning ordinance does not allow for cellular antennas or towers. The Zoning board needs to keep our small hamlet from being trampled by an invasion of thousands of patients and employees at the proposed Summit Medical Group Site. The parking is not adequate for that site.... it does not even come close to meeting the code. The project needs to be scaled back or denied.   more ›

Another Italian Restaurant Proposed for Downtown

In what seems to be a summer of Italian restaurants, another one has been proposed for downtown Millburn. Driola LLC of New Providence has proposed to open La Pergola at 120 Essex St., which was once a bridal salon near the corner of Essex and Lackawanna Place. The space has been vacant for some time. The proposal is going to the Planning Board for review at its next meeting on Aug. 18 at 7:30 p.m. at Town Hall. The restaurant would have 80 seats, according to the plans filed at Town Hall, and the owners are seeking a variance for parking. Several Italian restaurants have opened downtown in recent months, including Osteria Mediterrania and Cafe Luna.
